TNRDC attempts to frame Sanaulla but the villagers and the 0olice see through the game.

On June 8,2002 Sanaulla, a resident of Kanathur and an auto-rickshaw operator/driver was rushing his wife to the hospital. She had had an accident in her kitchen and suffered serious burns.

His vehicle was stopped at the Uthandi Toll Plaza of TNRDC where a toll of Rs.24 was demanded of him. All that the poor fellow had was some petrol in his auto and he hoped to race to a free Govt. Hospital for his wife's care. Some friends had promised to follow later after collecting some money.

This was a common enough incident at the Uthandi Toll Plaza, where villagers simply don't have the money for the strange tax demanded of them. An argument ensued. TNRDC marshalled its security guards and bid them to surround Sanaulla's auto. He was getting impatient and the guards under the direct command of the Plaza staff were taunting and crowing.

Sanaulla decided to break out as his wife was moaning. When he attempted to do so, the TNRDC staff hectored the guards to stop him. A burly guard grabbed a bar on the departing auto. He lost his grip and fell. He suffered a few scrapes.

TNRDC decided they had a case for exemplary punishment at the hands of the Police. They urged their injured guard to file a complaint with the Police and soon as he did, poor Sanaulla had to transfer the care of his wife to a relative in order to present himself at the Neelankarai Police Station. The Inspector there could clearly assess the situation as TNRDC had been daily asking the Police to intervene and help them collect the toll. He knew that TNRDC was angling for 'exemplary punishment' to be meted out to Sanaulla. By now a crowd of over 50 villagers had gathered at the Station.

The sensible Inspector decided that he would have a chat with them. He sympathised with their plight in regard to the burden the toll imposed on them, but was helpless in the matter as TNRDC had armed itself with a Government Order. He was obliged to intervene soon as law and order was broken. The villagers complained that TNRDC was being provocative. At about 8 pm after nearly 3 hours of detention, the Inspector let Sanaulla go with the general advise to the villagers that they must seek remedy elsewhere and not get involved in law and order situations.

As the only way the villagers can do this is to pay the toll and as they didn't have the money for it, what they were to do if TNRDC sought to create a law and order situation routinely? The Inspector said he would restrict himself to saying he would arrive soon as law and order was broken and the villagers have to consult other institutions as to how they should seek relief.

The villagers then saw it fit to leave a memorandum at the station so that TNRDC's clear strategy of framing villagers in law and oreder cases was on record.

Sir,

The toll on ECR has greatly affected us. In particular autorickshaw drivers' families have been reduced to poverty. TNRDC has been promising relief for residents and it is six months such an assurance was made and yet nothing has been brought forward.

Understandably car, van, auto and fish-craft drivers have been agitated. While this is the case, TNRDC staff have resorted to various intimidatory tactics: they abuse, they grab hold of shirts, they snatch vehicle keys, they show a pistol like object and threten etc. They file false complaints with you. These are routine happenings now.

We residents are exploring various civic means to seek relief. In the meantime we request you to warn TNRDC to moderate its ways.

On June 9, 2002, 5 PM a meeting was held in the premises of Morning Star School, Kanathur to discuss and work out a response to TNRDC staff's provocative ways at Uthandi. The meeting was attended by 36 people. It was a direct response to the treatment meted out to Sanaulla.

Some of the points raised by various participants were as follows:

*Despite provocation by TNRDC those that don't have the money to pay the toll should simply declare that fact and ask TNRDC to take whatever legal action it chose as a consequence. It is not a crime not to have money and if the citizen does not have money to pay TNRDC to reach home, then he should be ready to plead guilty in the court.

*Do not fall into the trap being set up by TNRDC of provoking you into any form of violence, which will cause the police to intervene. Of course rush to the assistance of a fellow resident of ECR who is being harasses by the TNRDC. But arguments and protests should be entirely non violent.

*Some speakers asked why the toll gate was not set at Tiruvanmiyur? They wondered if that was because highly influential people reside there and Injambakkam, Neelankarai etc. Was Uthandi chosen in the belief that from that point onwards the simple folk can be bullied?

*In return for the toll, instead of any advantage of time and money saved, all that the residents got was tension, fear and price rise.

*The toll concerned even non vehicle owners. Why should guests coming to a wedding in our village pay a toll? Why when rushing to a hospital in an auto must a resident pay? We may be bringing relatives in a taxi from the railway station - must we pay? Why should eggs and vegetables and all other things cost 5% more this side of the toll gate? Won't people without vehicles today not buy one in the next 30 years, the period of TNRDC's lease?

*It was highlighted that even at the reduced tariff, each vehicle would pay over Rs.5 lakhs to TNRDC over the next 30 years.

*The meeting ended after expressing solidarity with fellow residents of ECR and with a vow to battle with every available civil means until this cruel levy is repealed.

Citizens along ECR unite to repond to TNRDC. Result? A resolution and a petition.

At about 10.00 AM on June 9, 2002, a meeting of the Kanathur Grama Sabha took place at the panchayat office grounds and the following resolution was passed among others:

Resolution No. 12 regarding the toll being collected on the ECR

The toll collection centre set up within half a kilometer of our village has been collecting a tax on autos, vans, cars, meen-body vehicles, traders, fishermen and their families. The adverse effect has spread amongst all. Prices have risen like quick poison. Alone among the citizens of the Indian Republic we have been driven to the humiliating situation of having to pay a toll to reach our homes. Since the toll is being collected from school buses also, students are being affected also.

Harsh words are used against people not in a position to pay. False complaints are foisted on them to implicate them in law and order cases.

This resolution condemns TNRDC and demands that total exemption be granted to the people along ECR and also that due protection be given from false law and order cases.

On the next day -- June 10, 2002-- the following two petitions along with a copy of the resolution cited above were presented together by Thiru Karunakaran, N Kamalakkannan and K M Sett, to the Collector, Kancheepuram Dt.

The Petition was numbered as 0008850 and received by the Collector personally with an assurance that he would forward it - along with the many others he has received- to the concerned authorities.

Sir

The toll that is being collected at Uthandi has adversely affected car, van and auto users, fishermen, traders and many others in the area. Because of the toll trade, tourism and visitor revenue has fallen. Further commodity prices have risen to poisonous levels. We have been driven to the situation of having to pay money to reach our homes and not being in a position to do so. We therefore request you to take steps to offer full exemption from the toll to the residents of ECR.

Further, the staff of TNRDC have been resorting to humiliating ways in respect of citizens who are not in a position to pay: They grab their vehicle keys, they abuse them, they threaten and intimidate them, they file exaggerated complaints with the police and make citizens run up and down etc. These are daily occurrences at the Uthandi toll plaza. It is clear TNRDC is trying to create a law and order situation to implicate citizens. There is an atmosphere of fear in the area.

In connection with this, on June 9, 2002, the Kanathur Panchayat met and passed a resolution on the subject. Therefore we plead that you to intervene at once and grant 100% exemption to ECR residents and to protect the citizens of this area from TNRDC which seeks to bring the fair name of our Government into disrepute.

The toll that is being collected at Uthandi has severely affected the local people.

Many public spirited individuals and social service groups have been trying to reason with TNRDC regarding the unjustness of the toll on residents.

Ignoring such pleas, TNRDC has in its employ what it calls security and uses them to threaten and provoke local residents.
We therefore request the Honbl. Collector to intervene and arrange for full exemption to the people of residing along ECR.

An incident at Uthandi gives an insight into TNRDC's mind

[Read below in Gratian Govias' own words his harrowing experience at the hands of TNRDC]

"It was the 1st of June, returning home after having visited my sick mother. It had been extremely hot, which added to my depression of seeing my mother so unwell, when I came up to the Toll. As a resident and a member of ERPOA, I questioned the justness of the toll, to reach my home, 2km. from the Toll Booth at Uthandi.

"I was then asked to move to the side, where I was directed to a gentleman, Mr. Joseph, dressed very nattily and in very sporty coolers, exuding an arrogance, over all he surveyed. I explained to him that I am a resident of Muthukadu and 00that I have used this road for m0any years, with all its faults quite happily and that I had been paying all my taxes. TNRDC had robbed this traditional road from me and is now demanding a toll for me to to go 00000000home. To cut a long story short, he refused to accept my pleas. But the conversation, not going his way, he stopped me short, walked over to the front of my car and asked me to run him over, if I were to use this road. I was aghast and was left speechless momentarily.

"I then told him that what he was doing tantamounts to hooliganism, unbecoming of an employee of TNRDC. I suggested to him to seize my car or have me arrested, if he felt I was breaking the law, by refusing to pay the toll to go home. The shocking reply was that he has no powers to do that and that is why he was wanting me to run him over, so that he could lodge a police complaint for hit and run. Shocking but true, this bag of dirty tricks by TNRDC.

"My wife asked Mr.Joseph to come over to her side of the door, but he refused and asked her to get out of the car if she wanted to say something. Though irrated by his lack of chivalry and manners, she stepped out into the blazing sun, to try and defuse the situation, but met with an equally unresponsive Mr.Joseph. By now we had a posse of security guards surrounding the car and enters Mr.Sethuraman, who I was given to understand was Mr. Joseph's boss.

"Seeing him, was a bit of a relief, as he looked a pleasant and reasonable man, so I moved to him to explain my plight and inability to pay the toll. Lo and behold, he opened his mouth and a tirade flowed out, and for maybe a few minutes, may be ten, he took me through how this road was a private road, et al and at the end of it I was very sure that, only he and God understood, that conversation.

"We didn't get anywhere, so I was made to lock my car and walk home, that 2 kms., with my family (my wife,my two daughters, five and three years old and their maid) in the blazing 1pm sun. Not a heart melted. Anyway we reached home with much difficulty, my elder one being a gem, braved the tiredness to walk along with me, but reached home only to purge from sheer exhaustion and had to be kept on liquids all through till that night.

"Once back home, on contacting the Secretary of ERPOA, Navaz, he bandied together a few of our resident members, including our irrepressible President, D.V. and we went there to lodge our protest. The Police were contacted and informed by us that we were going to lodge our protest with TNRDC at the toll. He advised us that all he could say was, obey the law but if we didn't, and he would come in if there was a traffic violation or law and order problem! So was this an offence?

"We then met the TNRDC officials to lodge our protest and told him that we were prepared to court arrest or have our vehicles seized, but were not prepared to pay the toll. We would rather give it to a charity but not somebody who robbed our road from us and then make us pay for its use!

"But TNRDC would not give a receipt for the vehicle. Over the phone their boss Mr. Malmarugan told our president DV, that he would issue no instructions to the staff as to how they should conduct themselves when individuals refuse to pay. Mr. Joseph added for good measure, that when as a crowd he would let us go, but come individual cars, he will repeat this performance of harassing and obstructing us till we break and pay, all this in his official capacity as the representative of TNRDC at the toll booth. Add these together and see what you get: TNRDC has chosen to practice --selectively-- intimidation, provocation and eagerly awaits an incident so the police can come in. If this was not unlawful behavious what is?

"Thank you ERPOA, thank you members, I spoilt your Sunday and TNRDC spoilt ours. I look forward to the day and soon, where TNRDC toll booth is a monument of the past and we can be proud that we have collectively taken back a road that was unjustly robbed from us."
